Steps to Divorce in Florida
The first step that you will want to take toward divorce is to hire a Jacksonville
divorce attorney who has the experience and ability to take on your case.
You will then need to file your divorce in the county that you were last
residing in as husband and wife.
After your divorce case is filed, the other party will be served with the
divorce papers. The papers will be personally handled to him or her by
an officer from the county division Sheriff's office. The party that
has been served the papers has 20 days from the date they received the
papers to file. If they do not sign the papers, the divorce proceeding
can begin without their approval. There are exceptions regarding
military divorces, however.
Each party will file the necessary paper work and will have to provide
a financial statement. After the divorce lawyers are substantially aware
of each person's financial situation, the issues of the children involved
will have to be decided. A parenting plan should be developed during this
step. This plan will have to be in agreement to both parties.
Mediation is the next step that typically occurs three months after filing. Your
case will be completed after the judge signs your agreement. If no agreement
can be made, you will have to obtain a final hearing before the judge.
This judge will then decide your case.
